Some decisions and cases support that a corporation even if it is owned and operated by a single person may hire that same individual in an H-1B capacity. This is based on the concept that the corporation is a separate legal entity fron its owner. However, self-sponsored H-1Bs are subject to careful review. I am kind of confused. For UK visitors visa after I fill in the application forms do I need to go to a center to do my biometric. I am opting to submit the forms in person at the chicago center ...is the biometrics thing will be done during the submission at chicago..?

Currently am on H1 with GC Sponsoring company. I have also filed my I 485 in July 07.
I have got a contract project interview with a prominent company. But I was told that I have to be on W2. I am not clear what does that mean.
Does it mean that I have to move over to EAD if I get the offer?
Can I still work with the sponsoring company and be on w2 for the contract. I am not sure what is correct way of going with the offer. Can some one help me understand this?

Hi,
I am renewing advance parole (i-131 form) for me and my wife. Can some one answer what the "class of admission" means on the form and how do we fill it?
I entered the US as H1-B but moved to EAD status last month.
My wife entered the US on advance parole and is currently working on EAD.

Hello,
I am on a H1B with company A. I've been offered a job with company B which is currently processing my H1 transfer paperwork. I had accepted the offer letter from company B and had submitted all my papers for H1B transfer.
The starting date in the company B is 20th Nov as per offer letter. Now I had decided to stay back with the company A (by 18th Nov) before joining the company B. Is there any issue by doing so?

If your EAD is based on your husband's I-485 app I don't see any reason as to why that should affect your gc process if you move jobs.

Hello every1,
A SVP of 7 equals 2-4 years of education/training or experience (A job zone of 4 is treated as an SVP of 7.0 < 8.0).
A SVP of 8 equals 4-10 years of education/training or experience (A job zone of 5 is treated as an SVP of 8 & above).
A MS Degree is calculated as equal to a BS +2 or 4 years experience and no education.
NOW, BS + 5 / MS + 0 -- Minimum qualification for EB2..
So now a person working in Job Zone 4, which requires minimum of BS + (2-4) experience would get an entry level job at OES Level Wage 1.
So Can we conclude from this that a job which falls under job zone 4 which needs to applied for EB2(basically raise SVP to 8) would have a minimum OES Level 2 wage ????

Hello All,
I just looked thru couple pages on this forum to see if there is already a thread on this question but didn't quite get to see it.
I got into the I-485 queue during July-07 VB fiasco. My applications reached USCIS before the Aug-07 fee revision, so I paid fees according to the old schedule.
However, I did apply for extension last year in March-2009 and paid the new fee ($305), got the documents and even travelled last year and came back into US using the AP.
Now it's time for renewal again, and I'm wondering if I'll have to pay the fee perennially annually?

P.S: In the I-131 instructions, on page 8, there is a note regarding fee which talks about no fee if I-485 was filed after July 31, 2007. Mine was filed after July 31st, but with the old fee structure.

My wife's EAD expires 10/10/08, she is currently on H4 but we filed last july and got our EAD/AP. I am planning to send her to india in May and she'll be back in November around 4th (AP expires Nov 19th).
Please help me with info on these questions?
1. Does she have to be in USA to apply for EAD renewal?
2. Can she apply for EAD renewal in May (5 months in advance), I know AP cant be applied before 4 months but dont know about this EAD.
3. Or Can EAD be applied after it expires also, if yes till howlong after it expires?
4. Also she'll come back on 4th Nov and applies for AP immediately, is this OK if she applies before expiry date of Nov 19th but doesn't get the approval? (I know that she cant travel until she has a visa in passport or AP again)

You can keep extending the H1-B till your Green card is approved.

I have applied I-485 in July 2007. My Priority date is May22, 2006 (which is current as per August VISA Bulletin). But I haven't received the Finger Printing notice yet !!
I also went to Local Office but they also couldn't help me.
What I am suppose to do in that case?

Hello Everyone,
I need some suggestions from you guys.
My Employer A filed my green card labor in April 2000.
I was working with them on H1B till May 2003.
I moved to Employer B on H1B in May 2003.
Employer A continued to process my GC, and they filed my I485 in Jan 2007. I paid for the expenses.
My I485 is now pending at TSC.
Also Employer A confirmed they will support till i get my GC and I don�t have to work for them.
Can I use AC21 portability to move to another employer C using my EAD?
Do you see any issues i may face since i am not working for employer A?
