On May 1, 2006, hundreds of thousands of immigrants around the country demonstrated against a restrictive immigration bill introduced in Congress. This weekend, similar demonstrations will occur around the US. I'll be attending my 20th law school reunion in Chicago this weekend and am hoping to attend that rally. I'd really rather be at the one in Phoenix and look forward to hearing reports from there.

Hi,
My employer filed H1B transfer in Feb 2009. however he could not receive RFE letter with in time on mail and only received after RFE submitted date was expired which is May 25th, 2009
In jun1 1st week , he filed for the RFE extension for the stated reason and also refiled H1B to make sure that I should be in valid H1B status in case of first H1B denial in mean time
Employer submitted all the documents related to RFE on June 20th and it got approved on jul 1st.
What are the best options for H1B refiling case
in case if it is denied, will it super impose the original H1B approval ?
is it good idea to cancel/revoke pending H1B refiling case ?

I joined company ABC on H1B in 2005.
In Nov 2006 company XYZ filed my GC.
H1B got transferred to a couple of companies because I changed jobs while GC was being processed in parallel without being affected by my job changes because it was filed by another company.
In Oct 2007 got my EAD for a period of 1 year. Kept working on H1B only though.
EAD expired in Oct 2008. Applied for a new card but never received it. Did not apply for one after that.
In Nov 2009, I quit my job and moved back to home country giving up my H1B while still not affecting my GC because company XYZ agreed to keep it under process.
So at this time, I have no H1B and no EAD card. My priority date is however going to be current soon.
Now...
1) Do I have to be in the country before my dates get current or can I do that later?
2) On what status do I enter?
3) Can I delay the process somehow without affecting my GC?

Please report your employer to DOL for discriminatory pay practice, if you think the pay difference is solely 'cause of your immigration status.
And yes, you can change your job when you want through AC 21.. please browse the forum for AC21 process...good luck!

I have added my wife to green card application. Can you please let me know when she can expect receipt notice and Fingerprint Notice and when she can expect her GC. TSC is processing my/her application. My Priority Date is in Aug 1st 2006.
I am one of the ones who had missed the July 07 boat. My PD is finally current.
My attorney is getting ready to file all the items (485, EAD, AP etc) tomorrow.
How soon can I expect the FP Notice?
Also, since I am applying only now, how long before I can hope to see Green?

I am asking this for my sister who is working under J1 (start in October 2007 and valid for 1 year). She already get a J1 visa stamp and re-enter US as J1 status
1. Change of employer is not permissible in J1. Can she submit a new J1 petition and thus ending her current J1 petition early?
2. How about the 2-year home residency requirement (HRR)? Does she need a waiver for the current J1 she is doing now OR can she satisfy the HRR after she finishes with the new J1? The new J1 will not end later than the current J1. So, practically she will be in J1 for 1 year only.

Company A had applied for an RIR Labor app in Oct'2002. In Mar'06 we got a letter saying that case was closed. Then the attorney asked it to be reopened and it was reopened. Then now end of Aug we got the approval.
Im in my 8yr of extension based on this RIR.
Ok since then in early 2004 Company B bought Company A. Then in Mid 2004 Company C bought Company B. Attorney at that time said i dont need to file any H1 and can stay in the H1 from Company A because it was a successor of interest !
but now the attorney is saying that it will be very difficult to prove this is a successor in interest and there is no way we cna get the I140 approved.
So..
1. What do you guys think ? Has anyone gone thru' something like this. Any ideas ? I have also applied for PERM with the current company.
2. How long can I continue without filing I140 for the labor that was approved.

Hello IV.org - I am on H1visa, which is valid until Sep 30th 2010 with stamping. To get eligible for a new 6year H1visa - Can I work for the same company but geographically located out side of USA for one complete year. [ Let's assume from Oct 1st 2010 to Sep 30th 2011]
Then apply for the new H1 from the same company in april 2012? OR can I apply in april 2011 and enter US at Oct 2011?

- Regular

What is the difference b/w two. Can EB3 candidate file for I140 Filing Type in Premium category.

I know that the EAD card comes directly to the applicant and not to the attorney.
What about RFE on EAD? Does that too come directly to the applicant?
Pls lets know when you get your EAD. It would be interesting to see how long it takes with this avalanche of EAD applications

H1-B quota got filled up on May 26, 2006. You have to wait till April 1, 2007 to apply for H1-B, unless the company falls in the exempt category (non-profit, university...). If the SKIL bill is passed in the lame duck session it can change things as well.

I fall in Schedule A which is going to retrogression begining Nov, 06.
I am on H4, meanwhile i just made it to file my I140, 485, 765 and AP concurenntly, hence will get my EAD, but no approved 485. My situation is I dont want to be with this employer for long for this is in upstate MI, where my spouse wont be able to continue the H1, hence we will be living seperate for sometime.
Now after my 140 approval and 485 pending for 6 months can i change the employer, I heard something with AC 21 you can. But what are the pros and cons with it.
Can my employer revoke the approved 140 after 6 months too.

Please let me know how long is the average time to get the cetification from atlanta center. (One of my friend applied on 07/17/07 and got the LC on 07/23/07 from atlanta center).

You could take a look at Track it. It will give you an idea of Atlanta backlogs . You could have a very good chance at Chicago though . Your friend was one in a million lucky and you could be one too .
