My I-485 is pending with PD of Oct 11 2006(EB2 India). I have been on H1 as was not able to add my spouse to my initial 485 application. As my H1 expires on Sep 6, we recently filed for H1/4 extension and received an RFE for Employee-Employer relationship. We have to answer this by Sep 13. As a Plan B, What we did in June 2010 was
a) I filed for my EAD
b) My spouse got admitted into a school here and applied for COS from H4 to F1 with a valid I-20.
Both of these cases are currently pending.. My questions are:
1) As our H1/4 and I-94 expires on Sep 6, Would we still be in legal status after Sep 6 as both of our cases (EAD and COS) are pending?
2) After answering the RFE, if it is denied, would it impact my GC processing?
3) I understand that even if my H1 is denied, As I have a pending EAD, my status would be okay but what options would we have if my Wife's case is denied.

Valid AP is enough to travel - no one should care about your EAD if you are entering based on your AP. Ofcourse, always carry a copy of the I-485 and your wife can say that you are the primary applicant if they ask for her work status, etc...
Traveling with an AP (w/o EAD) should not be an issue. Good luck!

Hi All,
I have applied for H1b to F1 visa transfer with an i-20 from a university for the Spring of 2010.
Now, I received an admission from a better university for the same term (Spirng 2010) and I wish to join the Second University.
Could you please tell me the procedure to join second university.
1. Can I let the H1-F1 visa transfe (first university) go through and then apply for change of university or something ? If so, can some one outline the procedure for transfer of university (I am worried about the time it takes for the transfer of university for me to join for Spring 2010).
2. Is it possible to change the transfer application with i-20 and appropriate financial documentation ?

I recently got 3 year extension on H1B. I am currently in 8th year of H1B extension. All previous stamping were done in India, I have following question regarding the Visa stamping in Toronto-
Can I get my stamping done in US consulate in Toronto.
Where (Link) to take an appointment for stamping.
List of the documents required.
Anyone who has done it before, Please help

Hi,
I had applied for GC through my husband s employer for EB1 category. Recently USCIS websites has updated on its site regarding our case that I485 has been approved but I765 has been denied. Currently we are on L1/L2 visa. Has anyone faced such a situation? And what does this signify?

hi, my wife's ead expired in 2008 and did not get it renewed as she is a housewife and is not going to work. we got her ap renewed thouht and travelled out of usa. my question is when we re-enter usa will the port of entry officials ask for a valid ead for my wife for allowing re-entry. or just valid ap is enough for re-entry.

My attorney missed the RFE deadline for my H1B extension as the RFE was never received even though USCIS sent it. Please let me know your experience if any one missed responding to RFE deadline for H1B extension and what procedures they followed to fix the issue. Please advise.

As everybody knows by now, recently Arizona's Governor signed a law requiring local law enforcement officials to take into custody persons when they have a "reasonable suspicion" that they are present in the U.S. illegally. My friend and his wife re-entered US on AP a couple of weeks ago....They were paroled into US till Apr 2009. Their APs are valid till Oct 2008. Now his wife needs to go back to her home country immediately for a while (not sure how long due to family emergency).... If she doesn't plan to return before her current AP expires, what are her options to re-enter. My friend is still on H1 status valid till 2010, no H1/H4 visa stamps.....If she intends to stay home longer, can she re-enter US on a H4 visa after getting it stamped...If she plans to return before her current AP expires, say in Sep 2008, is it safe to use AP because she will be out of the country for 5 months if she leaves now and we are not sure if someone can stay out of US for that long and re-enter on AP.....Any suggestions...His PD is April 2004 EB-3 India

I am a new member. I read some of the posts on this website and know that there are some Singaporeans in this thread who have applied for the H1B1 visa under the US-Singapore Free Trade Agreement. Questions:
1. How long does the process of applying for the USSFTA H1-B1 take?
2. Where is the best place to apply for the USSFTA H1-B1 visa?
Please advise especially if you have already done it. I am about to start the process. Any advice is highly appreciated.

My husband's labor was filed in the end of June, no response yet. It was much faster for me in 2006. I would also like to know if anyone got a response.
