Wow! This act was so good. And I see 27 sponsors! What ever happened to it??? Maybe we should petition to get this introduced again, this was more like a real reform. It seems like Democrats supported it, but probably lost the fight with Republican congress at the time.

Do you think the lottery will take place for 2010 year H-1B filing?
zero I think...
H1 filing follows the general employment scene, and with the current employment levels, and the relatively low levels of recovery being seen so far, the chance of a lottery seems almost nil....
H1s for last year ran out just last week, why would 65k cases show up within a day just 3 months later?
However I dont expect it to last till December 2010 like it did this year. Employment is going to slowly improve going forward, TARP H1 hiring restrictons dont apply to many banks...

I filed 485 last july and want to file EAD now. I had FP done last year. If I do efiling for EAD will I have to go to ASC for photos. I saw in other posts that they have linked Biometrics but what abt the photos ?

eFiling EAD will result in ASC appointment for code 2 biometics (Finger Printing of right Index finger + photo). You need to take the appointment letter and one form of photo id (passport or drivers id).
I had my ASC apt. for eFiled EAD last week (Feb. 12th).

I'm A medical student who has come to do a 1 month internship(Clinical Elective) at a University on a F-1 visa valid till mid may 2009 .My internship here ends at the end of march. I have also 2 internships(cliinical electives) scheduled for the month of May and June as well at ANother University . The main problem is that the other univ require me to be on a B-1 and not on a F-1 . My present school has called them and requested them but they rejected the plea. They want me on B-1 . Now my question is that "Can I change my status from a F-1 to a B-1 while in US" - I have a valid visa which is not yet expired .
It would be appreciated if u can tell me about the forms that I shall need to fill in for the same ? Do I need to hire an attorney for it ?

His actual date of termination with his previous company was 5/31/2007, but in the labor filing he has said that he was employed with the previous company till 6/30/2007....

Can I count part time experience obtained before my Bachelors degree for an EB2 petition?
I have 2.5 years of part time experience, can we use this and apply with MBA+1 requirements?

Fancy meeting you here, dohko! The experience at half time can be counted to be 1/2 time itself - i.e. 2 years under 20 hrs./week = 1 yr. full time.
Your experience however has to be obtained AFTER your Bachelor's degree.

I have currently applied for H1B visa under Masters Quota (Regular Processing). And its still under process but I want to know if by any chance I get rejected this year, how much are the chances of being approved when I apply next year. I just filed for an H1B transfer in April. My current H1 is valid till April 2010. Just got an email from CRIS stating that my current I-129 case which was approved in April 2007 has been reopened at USCIS determination for review. Is there a problem or is it just normal procedure to look at the original H1B petition? Have transfered H1B before but have never had this happen. Is this something new that they are doing? Incidentally I am on the 10th year of my H1B and have a copy of the approved I-140 based on which we filed for a 3 year extension.

My PERM was filed in Dec, 2006 and was denied on April, 2007. As per my employer's lawyer it was erroneously denied by DOL. The lawer has received the denial letter but no reason was stated. He was keep on follwing up with DOL but no answers. On Aug 2007, lawyer was followed up again directly with the DOL office in Atlanta , with the liaison at the American Immigration Lawyer's Association and also it was sent to the congressional office. Through Senetor we came to know that there was typo in the date field. The lawer is persuing to get the denal letter again with reason so that we can appeal. But we have 10% chance to get the another deial letter. Now lawer is asking for filling a new PERM. In between I lost 8 months and now I'm running out time. My 6th year is expiring on Sept08. Just incase if we din't get denial letter and file the new PERM on Mrach can we get the 7th year extension ? (We will show all the documents etc for previos denail case and there was no reason in denail letter. PLEASE HELP

Hi,
I applied for SSN for my wife using the EAD,the person at the SSN office noticed that the date of birth on the EAD was not correct, but still took the application.Our lawyer reapplied for a new EAD last week but we recieved the SSN, please let me know if my wife can work using the SSN or wait till the reapplied EAD is approved.
