The big news today was Senator Reid now backtracking and promising climate change legislation before immigration reform. But in a seeming effort to show the Democrats are close to ready to go on immigration reform, Senators Reid, Schumer and Menendez began circulating a detailed outline of a comprehensive immigration reform bill that appears to exclude Senator Graham. My friends h1b got rejected 2years back , he once again applied for new one in this fin year from diffrent company , does old petion will effect the new one, as he not shown th eold one while filing the new one

Dude / Dudette.. I dont work for MSFT but the general thing is .. wait for 180 calender days post your I485 and make a move using AC21. You don't have any provisions to move with AC21 anyways. Take it easy.

How do we identify EB3 or EB2 category in approved I-140 ?
In Section , it was written as "Sec. 203 (b) (3) (A) (i) or (ii) ".

I am in a unique situation. I have filed for my H1B through company A and pretty recently got a 3 year extension too. I also have an approved Labor and I-140 through them. This May the company had an asset only aquisition and is now operating under a new name and Employee ID. Since we are all open to file our I-485 I contacted my immigration lawyer and explained the company reorganization. At first the lawyer was claiming that we should file an Amended I-140 due to the reorg. My company lawyer informed my Immigration Lawyer that the new company has not taken over the liabilities of the old company, it only took over the assets. Now my immigration lawyer claims that I will have to transfer my H1B to the new company and move forward with my original I-485 application and then port after 180 days. I wanted to get a second opinion from someone on this board.

I think if she didn't indicate that she intended to do CP in her I-140, but rather indicated she intended to do AOS in the US, then it will be a pain in the neck to switch to CP

Folks,
When an h1b transfer via regualr processing (california center) is pending...and say the person gets fired /layed off etc....
Can another h1b transfer be done with just the recepit notice and previous I-797?
What's the risk? Some companies are not willing to do premium processing even if the candidate is ready to pay the premium process fee.

ur wife's parents can write an affidavit stating the petname alias realname.For instance if her petname is "rani" and true name "swathi".They can write an affidavit mentioning that" rani alias swathi "is my daughter in the affidavit and get it notarised from any lawyer in india.The sample format can be obtained from ur attorney.

Hi Forum,
My wife has an H1B visa which has been invalidated now because she had to travel to US with me on H4. Her petition seem to be valid. The I94 in her passport has H4 mentioned on it. Now we want to convert her visa back to H1. Since she has H1, I am wondering the H4 to H1 conversion process should be easier compare to applying fresh H1.
It would be great if you guys let me know what is the process of converting this without going back to home country.
I appreciate your help

I am trying to put together documents for my wife's 485 application. The birth certificate was re-issued a couple of years back (with corrections to her mother's name and including her last name which was missing earlier).
The lawyer says we need to put a good reason down for 'why a corrected birth certificate was not obtained until now'.
Do you guys know of a good reason to provide USCIS? Know of any reason which was accepted in case of your friends?
Please do advise. Thanks!

Is it okay with AOS application to take contract Job after six month of AOS filling.

You can do anything, using EAD or H1B if you have one, prior to getting your GC, as long as when you are nearing your GC, your GC sponsor or some other employer, is prepared to confirm that job same/similar to what is in LC, is available for you.

My company is filing 140 and 485 on a preapproved LC (PD of 2005)
But my original LC in P-BEC just got cleared (PD of 2003). They told that they will also use my original LC for 140 as this gives better chance than the substituted one.
1)How Can I have 2 140's ?
3)How will it effect 485?
I'm confused ..please answer
