    Great news! The Hatch widows bill (which removes the requirement that a couple must have been married for two years before a US citizen dies) passed and included in that bill were provisions extending the religious worker green card program and the Conrad 30 J-1 physician waiver program. Each of these programs were extended for three years. The EB-5 regional center program for immigrant investors was permanently reauthorized by the Senate yesterday.     Hello,

    It seems that I made a mistake in my DS-160 and my H1B got stamped with an error in my middle name. I repeated my lastname as my middle name so my full name appears as: 1stName 1stLASTNAME 1stLASTNAME 2ndLastname

    I have a Tourist Visa also stamped wich is OK. Also the data on my passport.

    My I797 is OK and everything else is OK.

    I am still in my home country. Should I be worried about it? Should I try change it here or in the US?

    In any event, what's the correct procedure to change it?

    I changed my employer 3 months back and didn't expect the dates to get current so soon. My labor with the new employer has just been filed. However, my previous employer told me that if I want to continue with my gc process with them, I need to be their employee again.
    Does it make sense for me to do this ? My 485 will not get filed until 10 days from now because I have yet to start with the paperwork.
    Will the dates retrogress by then? Please advise me folks.

    Talk to an attorney he should be able to kiss your employer's ass with lot of things.

    If your employer is paying more than what is mentioned in H1B, then you cannot do anything.

    One thing is clear just lecturing members to go meet up with the lawmakers is NOT working. IV needs to come up with some fresh ideas, I mean, we all need to come up with new ideas.

    Lets start brainstorming again. Here is a start

    1. Some how IV meets with the president or his staff and requests visa recapture an interim fix. Ask for visa lottery numbers to be allocated to EB numbers for 3 years
    Ask for relaxation in rules for changing jobs.

    2. Run full page or a big advertisement in a national daily asking for the above. I am sure people will contribute if IV takes initiative.

    3. Get USCIS working on our FOIA request asap. Complain to the president about it.

    4. Legal action

    I transfer my H1B to company B and works for company B. Now suppose if I want to go back to company A after six months and want to work for company A, does the h1b transfer required? (means, does company A requires to file whole h1b petition again?) Here my petition (I-797) with company A is still valid. And suppose if I want to go back to company A after 4 years, at that time my petition (I-797) with company A might be expired, does the company A requires to file new petition (tranfer) or just the extension?

    � My wife came here on L2 in Aug-2007 and then applied for EAD
    � She has been working on EAD since Aug-2007 with Company A
    � Company A applied for her GC on 18-Aug-2009 in EB2 while she was still on L2
    � Company A applied for H1 which got approved on 08-Oct-2009 till 01-Oct-2012
    � We travelled out of US on 10-Dec-2009 and only gave the L2 I-94 on departure, didn�t give H1 I-94
    � She got her L2 stamped from India and entered US on L2 on 03-Jan-2010

    Please let us know the following:
    � Is there any potential of her H1 getting cancelled because she entered back on L2?
    � Do we need to get her H1 stamped immediately by going to Mexico?
    � Is her L2 EAD still valid and can she work?

    My wife will be coming back from India during first week of Dec thru IAD. She has some type of infection in few of her fingers with few blisters. I am worried her fingerprinting at POE may not work and may show an error. Has anyone encountered this issue ever? Do they capture all 10 fingers? Her infection is only in few fingers.

    I have been working in DFT/Test field for few years now and it appears that my current group is leaning more and more towards Test Development for SOCs and less in DFT work. I really would like to pursue DFT as a career and have been looking for a job in DFT field. Not only that, moving to a newer company might help me in getting the green card faster; possibly.

    Is anyone here working in the DFT field? If so, do you know of any job openings in your group or anywhere else for that matter?

    Any help will be very much appreciated.

    I know ability to pay issue is analyzed at I-140 stage, but the ability to pay the proffered wage begins at priority date and ends at the time I-485 is approved.

    After I-140 approval, could be ability to pay examined again?

    I read that someone went to an interview and was asked for sponsor company's taxes in order to check if the company still had ability to pay the salary.

    Would be possible an RFE asking for updated financials of the company?

    On July 20, 2010, the House of Representatives passed, by voice vote, the International Adoption Harmonization Act of 2010, to amend the Immigration and Nationality Act with respect to adopted alien children.

    The International Adoption (http://www.h1b.biz/lawyer-attorney-1131866.html) Harmonization Act of 2010, HR 5532, will allow an adopted child to legally immigrate so long as the adoption is completed and the petition is filed before the child turns 18. The current age limit is 16. The bill would also restore an international adoption exemption that was inadvertently eliminated when the U.S. joined the Hague Convention on Intercountry Adoptions.

    The bill was sponsored by Immigration Subcommittee Chairwoman, Zoe Lofgren (D-CA).
