It's still too soon to answer these kinda questions..
So what's the final word about the EB3 all categories retrogression? Will that be resolved soon? what are the chances in plain english?

Hello gurus,
just wanted some help on filing for EAD (paper application) (self + spouse)
I will be mailing the docs (UPS) to this address:
USCIS
Nebraska Service Center
850 S. Street
Lincoln, NE 68508-1225
I hope this is the right address, we live in california, 2nd EAD, first EAD filed at Nebraska with the old fee. First time EAD was filed by the attorney, this time he is charging way too much.
Along with the application I am mailing the following docs:
1. check $340
2. passport pages
3. first EAD copy and receipt
4. 485 receipt
5. drivers license
6. I 94
7. copy of birth certificate
8. copy of marriage certificate
Does the check list cover everything or am I missing some thing. Please help gurus.

Is this True --??
It seems USCIS has set a quota of X number of 485 applications till SEP 07.Once that quota reaches, dates will retrogress.
After that 485s will be processed by PD and not by RD.

Keep an eye on the military appropriations bill Congress is working on for a potential immigration piece. The AP reports that Republicans want some serious money and personnel commitments for the southern border. And my own sources are telling me that some Democrats are looking at trying to get the DREAM Act in that same piece of legislation. Remember, DREAM allows for some who join the military to pursue permanent residency so it would be a germane part of the bill. A down payment on comprehensive immigration reform? Or the end of that effort and the return to piecemeal legislating?...

Looking for a lawyer that is somewhat familiar with the Child Status Protection Act to answer some questions. If you are in the NYC area and would prefer I pay a fee, please PM me. I have consulted a few lawyers already but none are familiar with the act nor have they filed for anyone that uses this act.
My father filed his Labor Cert. in Aug 1996. I was 19 at the time. He then filed his I-140 on July 2000, and his I-485 on Dec 2000. He received his Greencard in August 2001. I was 24.
According to this faq from Shusterman: http://www.shusterman.com/hr1209-faq.html
the new law provides that she would be automatically reclassfied to an appropriate category, presumably family-based 2B, and that she retain her father's original priority date. This would be the date that his employer submitted the labor certification application.
Does this apply to me? According to this, would I retain my father's Priority Date of Aug 1996? I currently have an approved I-130 with a priority date of Jan 2002 under F2B which my father filed after he got his greencard.

Okay, here's a shameless plug from a proud father for a worthwhile charity project of my fourteen year old daughter Eden. For the second year, she's organizing a 5-K to raise money for an art therapy program for Darfurian kids at a refugee camp in Chad. The program is run by the Hebrew Immigrant Aid Society, America's oldest refugee and immigrant assistance organization. Folks in Memphis - please consider coming out to run or walk. And others who are interested in supporting the cause can make a donation via the race web site. Thanks everyone! Eden's Run 5-K

Here is a question for one of my friend
He is a July 07 filer and has I 485 pending for more than 180 days, has EAD and AP.
All through the years he has been on H1. however there is a gap of 40 days between change of employer on H1. (The H1 is approved after this gap of 40days) Is he in the status during this gap of 40 days because he has pending 485 and has valid EAD/AP?

my wife and i went to renew our DLs.
i am on EAD and my wife is on AOS(pending 485) and we both have AP valid till feb 2010.
i got a temporary DL and will get 1 year DL in the mail.
my wife got temp DL but will get DL till feb 2010 only (expiration of AP-I94). they wanted to see I-140 or I-130 alongwith I-485.
i emailed flhsmv.gov and they also say that now you must show 140 and dependent names in 485 application which most of us dont have.

If the hospital (healthcare organization) is a non-profit body then they will not be subjected to the quota (I think). Maybe other members can validate this.
They are not subject to cap if they are non profit.

It seems like ages since the federal government transformed the rules on when and how foreign citizens apply for visas to enter the United States. Actually, the most dramatic changes occurred in the summers of 2003 and 2004. In 2003, the government dramatically restricted the authority of American consular officers to waive the appearance of visa applicants for an in-person interview. In 2004, the U.S. State Department stopped "revalidating"(renewing previously issued but expired) nonimmigrant visas from a central processing facility in the United States. More changes have followed. Now all applicants must submit the visa application on-line (all the better...
