Hello Attorneys,
I am filing for renewing of EAD. I am stuck at question #15 "Current Immigration Status" My last entry was on L1B in 2007. In 2008 I changed employers and started working on EAD.
Can you please help with this.

The National Foundation for American Policy has issued an important report analyzing the interplay between of trade laws and S.887 and S.2804, bills introduced by Senators Grassley and Sanders, which would impose an array of new restrictions on skilled workers. Language from these bills is also being considered for inclusion in the draft language for the comprehensive immigration reform bill. According to the report, provisions in the two bills that appear to violate US commitments under the General Agreement on Trade and Services include 1. changing H-1B wage rules to require employers to pay median average wages (S.887) 2. changing...

Hi,
I have my L1 Visa from X Company and I traveled to US for 2 months.
I also have my H1B Visa from Y Company stamped in my passport.
I am planning to enter US with my L1 Visa and then change my status to H1B after a month.
1) If I get a job, can I change my status from L1 to H1 within a month? Is there any minimum period to work on L1 for change of status?
2) Do I need the consent of my X Company for having the change of status to H1B done?
3) What documents are required for the change of status? I will not have my pay stubs during my stay on L1 status, as I will be paid just the per diam.
4) If I enter US with my H1B Visa and if I am deported to my Home country (because I just have 7 months) validity of my H1B (or) due to employer-employee relationship issue), can I still use my L1 Visa of my X Company to revisit US?
Please advise.

One of the options the President has had on the table - one every President has - is using an administrative option to provide temporary legal status and work authorization to those in the country illegally. Rumors have been spreading within the community of antis around the country and they've gotten a handful of hardcore anti-immigrant members of Congress to send a letter warning the President to drop the idea (if indeed it was really being considered. How could President Obama do what the paralyzed Congress can't? Two options come to mind. He could look at a blanket policy using...

It should not be a problem. Our GC's were approved when we were overseas and we came in using AP's.
Try to bring print outs of approval from USCIS website. If you have that, they will admit you as a PR. I tried explaining but they didn't listen and used the AP. If you have a printout they willl stamp your passport as a PR and let you in.

Hey there,
I have currently applied for H1B visa under Masters Quota (Regular Processing). And its still under process but I want to know if by any chance I get rejected this year, how much are the chances of being approved when I apply next year. Will it make a negative impact when I apply next year? I am currently on OPT and my course is under STEM. Also let me know if there are any other options.
Thanks

You should change to H-4 (assuming you are eligible) if you are not working. You should be able to change back H-1B later and get the remainder of your 6 years, without being subject to the cap, if you find a new employer. It is important not to violate status now, and not working violates your H-1 status even if the lack of work is not your choice.

If you're stuck in the US because of the Iceland volcano and it is causing you to overstay your I-94 departure date, you have options. Customs and Border Protection has just posted this notice: Travel Advisory: Delays Due to Icelandic Volcano Eruption (04/17/2010) If you or someone you know is stranded in the United States because of the airport closures in Europe due to the Icelandic volcano eruption and is about to exceed their authorized stay as a direct result of these closures, there are two avenues for relief: If the traveler is at the airport and traveling under the...

Hi, Thanks for the reply, but she did not even know at that point about this provision. This was a kind of typo error, (05 to 04) .
Is there a possibility to rectify this problem?
