Hi All,
My parents I94 is expiring on March 27th 2008.
We had filed for extension (form I 539) in California Service Centre with receipt date of Jan 02 2008.
Calif is currently processing Oct 2007 I529s.
My concerns are :
1) I think their stay here is legal till we hear back from USCIS on their extension. Please confirm if this is true.
2) If they get declined , they have to leave immediately. Is that period of stay considered illegal?
3) Is overstaying with legal extension an issue if they need to come again after 6 months or so? What is the criteria they look for for frequency of visits/stay periods at port of entry.
Will greatly appreciat all your personal experiences /wise opinion on this matter of pressing concern for us.

Can some one reply to my post please. My question is regarding EAD only. Once I apply for EAD and go to India what happens
1. If I am not there while it approved? Can my frnd send me the EAD to India?
2. if I get called for finger printing for EAD and if dont go for it? Will my AOS will be treated as abandoned?

Hello,
We have our 485 interview's next week @ the Baltimore Field Office. My PD is current for EB-2. My case is pretty straightforward so hopefully should not be a issue.
Would appreciate any comments from folks in MD who have been interviewed @ the Fallon Federal Building in downtown.
Particularly - can they approve our cases right there & then.? Will they stamp our passports for approval since PD is current for January 2011.? Can there be any issued with visa number not available, etc. ?
Any advice is appreciated.

Just wanted to find out how long it takes now a days to issue a receipt number because of the new H-1B rush during the first week of April.
If anyone has applied for H-1B transfer at CSC after April 1st, please update your status here to help others in the same boat.

My original birth certificate has all the details needed, except that my last name is an initial, and not spelt out completely. Would I require an affidavit with an expanded last name?

My wife is working for US firm on L2 VISA (EAD).
The employer is ready to sponsor her GC. We wanted to know what is the process for L2 candidate , will it be same starting from Labor .... or we can skip labor and make use of current L2 EAD to file I-485 directly ?
Nope...she has to start with Labor and apply for a 140 in either EB3 or EB2 categories. Only L-1A visa holders are eligible to skip labor and apply in the EB1 category.

You know CIS may issue an RFE at any point in the AOS stage..wait and see what the RFE about and respond it accordingly...I think if you are going thru an Attorney he will receive the RFE letter followup with him..

H1B petition approved on: 10/01/2005
Entry into USA on H1B : 04/23/2006
L1A petition approved on : 09/23/2008
Different people tell me different things, some say i will still be considered as H1B and hence have to go through labour filing since i entered USA in H1B status. Some say since my current visa is L1A, i qualify for EB1 category and hence labour is not required and i will get the GC in 6 months. Not sure what is true.

I made address changes to pending EAD renewal and I-485 yesterday in the afternoon for myself and spouse. Same day later in the evening I got email saying CPO for EAD renewal. This is a story of 8/20/2008.
I tried called 800 number and was told that they can't verify that address was successfully changed on the application.THey don't have access to personal information. They are asking me to take Inforpass to verify the address.
There is no LUD on either I-485 or EAD renewal after address change. Is LUD an indication that address change has been done? There are no infopass available for 2 months ( I will keep checking if somebody cancels )
Does anybody has any pointer as to how I can verify address change without infopass

As per the new information USCIS is planning to finish receipt update by end of the month. My application was filed on July 19th and received by B Fisher at NSC. All the folks who applied with me got their checks cashed last week.
My I140 was approved from NSC last year.
How many people are in the same boat. I know from other threads there are still people waiting from July 2nd.

My wife is currently applying for labor certification and I am planning to start my process for green card also. Is it advisable for both of us to apply for the green card? Is it considered duplication by the INS?
The reason for both of us starting the green card is that in case one of us has to move to a different job the other green card application might serve as a backup.
