As of May 29, 2009, approximately 45,800 H-1B cap-subject petitions had been received by USCIS and counted towards the H-1B cap. Approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits.

I understand the wages lesser than specified in Labor is a real potential issue. But what about wages much higher than specified? 10-20% increase will be fine, but what about 50% or 100% jump.
Many of us live in consulting world and in a billing sharing mechanism where your annual wages fluctuates. I am talking to a potential client which can give me a significant raise (please note I am not transferring H1 or using EAD and will be staying with the same GC filing company with 140 approved and 485 pending).
Has anyone ever met a real case when high wage jump created a problem?

You cannot apply for I-485 unless I-140 is approved as EB1 is purely based on I-140 not labor.

When I was on F1, I was able to get my EAD by going to USCIS office. Not sure if we can do the same thing after filing I-485

This might be little bit old, but I dont remember seeing a post on this. Employment-based immigrant visa fees almost doubled, Old fees $ 355, new fees $ 720 from July 13th. Does this mean USCIS will open the gates in Sept bulletin [to be released in August]?

Guys. Is this 7% country limit a hard or soft one ?. Assuming 1,40,000 total immigrant visas, India would get 7% of it and that is 9800. Then you have the preference category. Assuming there are unused immigrant visas from other countries, how do they get allocated ?. Does anyone has clear idea ?.

South Carolina Republican Senator Lindsey Graham has said many times in the past that the GOP needs to move back to the middle on immigration reform. He's putting his money where his mouth is and is leading the GOP's pro-immigration wing as they work behind the scenes shaping the bill likely to be introduced in the next few weeks. Family based green cards take a longish amount of time 5 yrs or so and your wife cannot enter US in that period. So if you plan to live with your wife in the US in the mean time here is an idea you can consider:
Give up your green card, then come back with H1 and your wife on H4 then reapply - you might get your green cards in 3-4 months because your 140 has an older priority date.

Can the IV core group can come up with the webfax to explain our reasonable concerns (to educate the Title V of Senate bill) to all members of congress (House and Senate Members)? This will help us during the conference committee (atleast lawmakers will know our legimate concerns). Also everyone will send fax and will contact lawmakers. Please let us know.

I am working for a client which gave me an offer for a respectable amount. it is much higher than the amount specified in ETA 9089 (F/5) column. my Onet code for the original labor is 15-1071.00. my new job is defined as System Specialist. my job functions( roles) are pretty much the same as my original labor certificate. I tried to search the Onet Code for System specialist and did not find a good match.
Can any one suggest me what are the options.
I also wanted to know weather USCIS will send any letter to new employer regarding to the offer extended to me. MY situation is the client is not willing to sponsor me.

I recently got an RFE for my I 485 Application.
Need to prove my non-immigration status from Nov 29 2007 to Nov 24 2008 .
I have I-797 ( H1-B approval ) for the above mentioned period. But My Last Name in the approval has a typo error ( in place of letter A they misstyped U). My Enployer has opened a Service request to correct the Name in H1 B approval. But he is saying that he never got the corrected approval. Time went by and i applied for H1 ext..i got the H1 extension from Nov 25 2008 to Nov 2011.
So My question is
Is it okay to submit all the documention that was sent to USCIS to correct the name along with the I 797,I-94 for the above mentioned period and explain them that we did not recieved the corrected I-797 ? or not
Please suggest me ..

I have applied for EAD renewal on September 1 2010. I have received receipt notice and checks are cashed . There was soft LUD on my case two weeks back without any change in status . To day I got email with case status � Initial Review� with following messsage
We have placed this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION on hold because there is a pending litigation that may affect the outcome. We will resume processing as soon as the litigation is resolved. We will notify you by mail when we make a decision about your case, or if the office needs additional information.
This is my 5th my EAD Renewal and earlier I do not have any issues with Renewals . My current EAD Expires in December 1 Week . Please advise what I need to in this case , as I do not have any clue about pending litigation. Can I check with Local office about what was the pending litigation or do I need to approach through lawyer

The normal process I heard is that they start at the 70 day to complete it by the 90th day. So you can expect it from 70th day onwards.
