First of all why do U wanna ask that? Its an employment based visa that ur GC is based on. So, ur employer shud ask that. Why are u asking IVans to do something which is not in their control??? Immigrants don't get to vote and may not have other rights such a welfare, social securicty etc. But USA as the greatest democracy on earth provides almost all of the rights to citizens and foreigners alike. In fact you can complain to your local, state & federal lawmakers and they will help you in your problems.
And yes a foreigner has the right to complain about any govt. organization including USCIS if their processes are adversely effecting him or her. These are the basic principles of the US democracy.

I filed my labor on Feb 5th and still in processing. My lawyer has opened an enquiry but so far no response. I read this in the Immigration -law site:
As to the problem of Atlanta National Service Center delays, there were rush of H-2B case filings and that Center had to switch around the resources from PERM to H-2B cases. However, the situation is under control and the Atlanta Center will see positive changes from here on in terms of the processing times. There are aware that in light of the immigrant visa number changes in July 2007, such changes should help in achieving some level of fairness.
Hope something works out quickly before we miss the bus. I am planning to send an email or request to my Senator. Any ideas on this?

Yes, I think it is just a letter.
Just like say, you do not want your Green card - you send a covering letter to USCIS and enclose the green cards. They shred the cards and process the letter update their records.
You can also send a letter to USCIS to withdraw your 485 - they will be happy to do so.
My dad had a expired green card (in the 70s) and recently when he went to consulate to get a toursit visa - he presented his expired green card (30+ years old) and they took him aside and completed some paperwork and took the expired green card and said they gonna process the return of expired green card - this is normal paperwork and procedure they follow.
What baffles me is - they follow all the laws perfectly - but when it comes to beneficiaries, we see all sorts of issues? I really do not think it is a training issue - this could be something else - maybe I am just speculating

Beware of HR 5924, this bill is planning to set aside 20k EB3 visa's for nurses instead of the current 10K. If EB3 folks loose focus and fail to push for recapture bill and somehow HR 5924 is passed. EB3 will be doomed.
Getting HR 5882 / S 3414 (recapture bills) through congress is the only hope for EB3's.
Changing the spillover will not help EBI because in both the spillover interpretations EB3I is the last in the chain. The only reason EB3I benefited from earlier spillover interpretations was because there weren't any ripe EB2-I cases available and it spilled over to EB3I. Reverting to the old spillover interpretation will not benefit EBI but sure it will benefit EB3-ROW.
Let us focus on getting the recapture bills through. Call u'r congressman/senator and start pushing for the recapture bill. EB3I has been benefited until now because of the AC21 recapture. Now it is time for another recapture.

You have gotten a lot of feedback already here, just some additional practical advice-
1. You need to decide whether you will be happy comprising for the rest of your life just so that you can protect your baby' life? Make a decision thinking long term if you think your marriage will work or not.
2. As long as you are in the US - be sure you are aware of the legal laws and don't do anything that will go against you (harrassment, abuse, etc). Allegations can be made but do not do anything in anger/frustration that acts as evidence against you in the future.
3. Make sure your wife DOES NOT TAKE THE CHILD AND LEAVE THE COUNTRY UNDER THE PRETEXT OF A VACATION. Cause if that happens then you will be blackmailed for your child and my advise would be to not travel to India under any circumstance since laws there are totally against the MEN.
3. If you decide to go for a divorce, find a good lawyer and get all the information. Do it in the US - laws in India will be in your wife's favor.
4. In general do not travel to India until you are assured that these issues are settled and you won't get stuck in India even if you go there only for a vacation.
5. Record conversations and build proof incase things go bad in the future. Do not take this lightly - this will be your only savior if false allegations are put against you in India.

Here is my story:
I came to US in 2002 and completed masters and been working since then. I got married couple of years ago. Whatever the monetary gifts the girls parents gave as part of the marriage, I put all that in an account on the girls name within 2 days of the marriage. We came to India and from then on the problems started. She and her parents want me to separate from my parents and support their family by sending money to their parents which I couldn't do. How can I leave my parents in their old age when they worked very hard to give a decent life. She has been harassing me mentally for this all the time. Recently her parents have been threatening me saying they will file dowry case in India if I don't send money or cut myself off from my parents. I provided for the girl in all possible ways, even encouraged her to join school to get a masters degree which she stopped soon. We had a baby recently and my parents visited us to help us with the baby. She started harassing them too by saying something or other.
I am very frustrated at this situation and I don't know what to do. I am on H1B and applied for 485 too. Anyways, he gathers himself and replies back �Son, this is going to take sometime to explain. Why don�t we go to McDonald�s for lunch.� As they are driving to McDee�s, the father is trying to rearrange his thoughts to answer his son�s question. They have a nice lunch and the father is finally able to answer his son�s question using the birds and the bees as examples (at this time the two bees at the coke machine are probably complaining to each other, why all fathers never talk about the actual characters). Anyway, after listening to his father speak. The son replies back, drawing out a piece of paper �It is still confusing to me. I agree with you. In order to achieve something, you have to give up something. Either it's the money, labor,time and effort. I sense that apart from very few , rest would like the fruits of labor without any type of contribution and effort. It would take herculean effort to change everyone's attitude. I hope Gandhiji will lend us an invisible hand in our struggle.
